

Law of Ukraine “On Waste Management” came into force on July 9 and the preparation of the
necessary legal framework, which will implement the mechanisms of the Law is underway.
What are the responsibilities of waste generators?
– self-processing of waste with a recycling permit or transfer it for processing to waste
management entities that have such a permit;
– keep records and reports on the waste generated by their activities
– develop and implement of plans of enterprises, institutions and organizations for wastemanagement
– submit a waste declaration (according to the new form) if the activity of such a generator of
waste results in the generation of hazardous waste or the annual generation of non-hazardous
waste exceeds 50 tons;
– compensation for damage to the health and property of Ukrainian citizens, environment,
enterprises, institutions and organizations as a result of violation of established rules of waste
management, in accordance with the law.

As long as the necessary legal framework is in preparation, each entrepreneur can already analyze
their activities in terms of requirements and start the following steps:
1. Classify your waste according to the new National List of Waste. The draft of this document is
already published and should be approved in the near future.
2. Determine whether the waste is safe or hazardous. If necessary, carry out the necessary
laboratory tests in accordance with the established procedure.
3. Understand what waste operations the facility will perform under the new legislation.
4. Prepare documents for obtaining permits for waste treatment operations in accordance with
Article 42 of the Law of Ukraine “On Waste Management”.
5. With regard to hazardous wastes, consideration should be given to: according to the new rules
such waste can only be handled by an enterprise licensed for a complex of operations including
recycling or disposal. So, in this case, you should take care of getting licenses in advance.
6. If the enterprise collects and transports hazardous waste to other countries, this type of service
requires a license.
According to the new Law, digital tools are planned, in particular the following to be made
available for businesses on the EcoSystem unified online platform:
– E-cabinets for business;
– a waste management information system through which waste accounting will be implemented,
all waste-related activities will be monitored and reported.
The information system will:
– submit documents and obtain licenses;
– apply online for authorization for waste treatment operations;
– obtain an opinion on the transboundary movement of waste;
– automatically generate a waste declaration. The company will only have to check the generated
file and sign it. Such reporting will also be sent by the system to the State Statistics Service of
Ukraine, etc.
