In these difficult times, we need to use all possible opportunities to develop the economy and increase the quantity and quality of recycling, as well as attract more investment in the recycling of secondary materials. Importing high-quality secondary raw materials (waste) from abroad provides an opportunity for the development of the processing industry.

The conditions for the import and export of waste in Ukraine are regulated by Government Resolution No. 1120 dated 13.07.2000 “On approval of the Regulation on the control of cross-border transportation of hazardous waste and its disposal / disposal, as well as waste from the Yellow and Green lists”.

If there are no hazardous components in the waste, this must be confirmed by special documents that accompany cross-border transportation. In order to transport waste across the customs border of Ukraine, it is necessary to obtain the opinion of the Ministry of Environment. This document is a confirmation that the waste is safe, included in the Green List and its transportation does not contradict the Basel Convention.

 

The need to obtain the opinion of the Ministry of Environment applies to all subjects of foreign economic activity who plan any movement of such products across the border. It is issued when waste is imported/exported across the border, which is safe for people and the environment. These are goods and substances that were already in use (second-hand clothes, waste paper, polyethylene, used car tires, etc.).

The essence of the procedure for issuing a conclusion is to confirm whether the waste of the Green List of waste, which is the object of export or import, is subject to clauses 6-33 of the Regulation on the control of transboundary transportation of hazardous waste and its utilization/removal, approved by the Cabinet resolution of Ministers of Ukraine dated July 13, 2000 No. 1120.

To obtain the opinion of the Ministry of Environment, it is recommended to submit the list of documents defined by the resolution:

  1. Application for export/import of green list waste;
  2. Agreement of purchase and sale and/or Agreement of foreign economic activities;
  3. Specification for the Agreement/Contract;
  4. Invoice;
  5. Waste passport;
  6. Information on the composition and properties of waste (the result of the information is the characteristics of the waste, the research protocol issued by an accredited laboratory for waste analysis and radiation examination);
  7. Certificate of quality / compliance / origin;
  8. Conclusion of the state sanitary-epidemiological examination;
  9. Documentation of substantiation of properties and scope of use/application of waste;
  10. Expert opinion of the Chamber of Commerce and Industry on the determination of the code of the Ukrainian classification of goods of foreign economic activity;
  11. Power of attorney for an authorized representative.

Copies of all documents are submitted personally by the applicant or his representative by proxy, duly certified.

The term of providing the service in case of submission of documents through the Unified Ecological Platform “EkoSystema” (eco.mepr.gov.ua) is 10 working days from the next day after the registration number is assigned to the document; in paper form – 30 calendar days (the time limit is provided for in Article 253 of the Civil Code of Ukraine).
