Environmental documentation in martial law: business consulting by Center LTD

The war in Ukraine has been going on for three months now, which has caused a tense environmental situation in the war zone. • Obtaining certain permits based on the submission of declarations with the need to carry out all procedures after the abolition of martial law, in accordance with the requirements of the Cabinet of Ministers of March 18, 2022 №314.
• Termination of administrative services in the field of monitoring, reporting and verification of greenhouse gas emissions, and, consequently, lack of inspections on this basis and liability for late submission of such reports, in accordance with the Cabinet of Ministers of 28 February 2022 22165 and the Law of 3 March 2022 №2115.
• Exemption from payment of the eco-tax for 2022 of enterprises located in the territories of hostilities, in accordance with the Law №2120.

These and other changes to environmental legislation are aimed at taking into account the realities of martial law and creating conditions for the implementation of the tasks assigned to the economy.

At the same time, in regions that have not suffered much or not at all from hostilities, environmental issues, as well as maintaining the viability of the economy are the basis for further development and reconstruction of Ukraine. The threat to the environment is global in nature, so we must continue to conduct business, taking into account the requirements of current environmental legislation.

The task of environmental legislation is to regulate relations in the field of protection, use and reproduction of natural resources, environmental safety, prevention and elimination of negative environmental impacts, conservation of natural resources, genetic resources of wildlife, landscapes and other natural complexes, unique areas and natural objects related to historical and cultural heritage.

In order to establish a set of mandatory norms, rules, requirements for environmental protection, use of natural resources and environmental safety, environmental regulation is carried out and permits are obtained by business entities.

• the content of harmful substances in food;
• maximum permissible emissions and discharges into the environment of polluting chemicals;
• harmful effects of physical and biological factors.

The use of natural resources in Ukraine is carried out in the order of general and special use of natural resources.

In order of special use of natural resources, natural resources are provided to citizens, enterprises, institutions and organizations for possession, use or lease on the basis of special permits, for a fee for production and other activities.

Economic measures to ensure environmental protection include setting limits on the use of natural resources, discharges of pollutants into the environment; setting environmental tax rates; compensation in the prescribed manner for damages caused by violations of environmental legislation.
