The Rada voted in favor of the draft law on Integrated Approaches to Permitting Activities and Control of industrial pollution

On May 30, 2023, the Verkhovna Rada voted in the first reading for the draft Law “On ensuring the constitutional rights of citizens to an environment safe for life and health”, reg. No. 6004-d dated January 4, 2023, which is aimed at implementing 75 of the EU Directive.

The aim of the draft law is to create a legal and institutional framework to prevent, reduce and control  industrial pollution to ensure the protection of the environment and the constitutional rights of citizens to an environment safe for life and health.

The draft Law defines the basic requirements for an integrated environmental permit, it implements integrated approaches in matters of permitting activity and control of industrial pollution based on the application of the best available technologies and management methods in accordance with Directive 2010/75/EU on industrial emissions.

The draft Law provides for a 12-year modernization period for all existing industrial facilities, in particular:

• one year for the implementation of the draft law,
• 4 years for the implementation of BAT norms (the best available technologies and management methods),
• and also, a grace period of up to 7 years is provided, so that everyone, without exception, has time to modernize.

Implementation of the Law will contribute to environmental improvement, ensuring environmental safety and maintaining ecological balance on the territory of Ukraine, and therefore ensuring the rights of citizens to an environment safe for life and health; will have a positive impact on the market environment, ensuring protection of  rights and interests of economic entities, citizens and the state, development of regions, public health and the environment.

This in particular by establishing clear procedures and transparent relations for economic entities, government bodies and the public in the area of integrated environmental permitting and the implementation of the best available technologies and management methods.
