On July 13, 2023, the Verkhovna Rada of Ukraine adopted in the second reading and as a whole the
\ngovernment Draft Law on Amendments to the Law of Ukraine “On Environmental Impact
\nAssessment” (project No. 8410.).<\/p>\n
The document was developed with the aim of:
\n– Simplification of the EIA procedure
\n– Helping to rebuild the economy
\n– Improvement of the norms of the current Law of Ukraine “On environmental impact
\nassessment”;, due to the need to implement the principles of digitization of the permit procedure.
\n– Shortening the terms of the environmental impact assessment procedure.<\/p>\n
The main objective of the Law is to optimize environmental impact assessment processes and
\nmaximize business support in Ukraine’s post-war recovery.<\/p>\n
The law provides for the following changes:
\n– shortening the time for public discussion of the notice of proposed activity from 20 to 12
\nworking days;
\n– reduction the time required to provide the enterprise with information on complaints and
\ncomments from the public before the environmental impact assessment notification from 3 to 1
\nworking day after receiving them
\n– shortening of the terms of publication of the notification, the Report on EIA and the conclusion
\nby the authorized central\/territorial body in the Unified Register of Environmental Impact
\nAssessment from 3 to 1 working day after their receipt\/issuance;
\n– notification of proposed activity and announcement of public discussion of the Environmental
\nImpact Assessment Report will be filled out in digital format directly in the Unified Register of
\nEnvironmental Impact Assessment. Authorized body will no longer be able to reject these
\ndocuments due to their non-compliance with the approved form;
\n– the requirement to publish notices and announcements in mass media is abolished. Instead, the
\nlaw proposes to involve territorial communities to ensure proper public information;
\n– the public will be able to register on the website of the Register for targeted information about
\nthe publication of information and documentation in it;
\n– a comprehensive list of grounds for refusal to issue an environmental impact assessment
\nopinion and a shortened procedure for carrying out an environmental impact assessment in case
\nof elimination of deficiencies that caused the refusal are determined;
\n– establishment of grounds for declaring the proposed activity inadmissible;
\n– public hearings during martial law would be conducted b videoconferences;
\n– shortening of the term of issuing the opinion by the authorized body from 25 to 15 working
\ndays.<\/p>\n
Environmental impact assessment shall not be subject to restoration work to eliminate the
\nconsequences of armed aggression and hostilities during martial law and during the reconstruction
\nperiod after the end of hostilities.<\/p>\n
The adoption of the document will ensure the validity of decisions concerning proposed activity;
\ntaking into account the interests of the public concerned; guaranteeing the right to a safe
\nenvironment, as well as allowing paper documents in the framework of the environmental impact
\nassessment procedure, which in turn will shorten the terms of its implementation, accelerate the
\npost-war recovery of Ukraine and stimulate business development taking into account the
\nenvironmental component.<\/p>\n
Our company’s specialists analyzed this Law and prepared changes to project management programs
\nin order to provide services in accordance with the latest requirements of legislative initiatives.<\/p>\n
During the implementation of the procedure in Ukraine, Center LTD prepared more than 500 reports
\non EIA, which received positive conclusions.<\/p>\n
